Ageing makes certain legal issues more relevant than before.  Although we don’t like to think about what will happen after we die, in order to make sure your intentions are enforceable and your assets go to those you care about, you should consider making a will.   With the help of a solicitor, you can be sure that you will be getting a legally valid will that is based on what you want.

Ws we age we can come across unwelcome and sometimes incapacitating health issues.  To make sure your affairs are properly managed should the unfortunate happen to you, you should appoint a Legal Power of Attorney (LPA) whilst you are still healthy.  There are several types of LPA including:

Property and Affairs LPA – responsible for your financial affairs and decisions related to your assets.

Personal Welfare LPA – responsible for your general welfare and is capable of making decisions regarding medical treatments, day-to-day care, residential arrangements etc.

An LPA application costs £150 and is payable to the Office of the Public Guardian.

Trust creation and administration

Trusts are flexible mechanisms, either setup within someone’s lifetime or through a will or intestacy.  Under the authority of trust creator, trustees hold and use assets for the benefit of named person (the beneficiaries).  For elderly clients, trusts are particularly relevant where you want to make sure their grandchildren can receive the benefit of your assets.

However, given their inherent flexibility, trusts offer numerous benefits and naturally there are many reasons as to why someone would want to create a trust.
